Sean Nolan’s work includes complex commercial and bankruptcy litigation for public and private companies, investment funds and individuals. He previously served as a business analyst at a healthcare marketing consultancy where he reviewed and analyzed data, generated substantive reports and communicated with clients. These experiences developed his financial acumen, data analysis and communication skills which he brings to bear daily in assisting clients.
Sean has served clients with regard to:
- Restructurings
- Intercompany investigations
- Breach of fiduciary duty claims
- Tort claims
- Emergency injunctive relief
- Government investigations.
- Assisting a publicly-traded company with regard to a leveraged buy-out, demonstrating that constructive and actual fraudulent transfers had occurred in connection with the transaction and recovering for creditors.
- Working with the governance committee in regard to a bankruptcy of the client’s parent company, investigating intercompany transactions before determining if claims should be released.
- Helped an investment fund client settle on favorable terms with a former employee suing for various causes of action, including breach of his employment agreement.
- Defended an investment fund client in a suit filed by minority noteholders seeking to enjoin the client from instructing the trustee under an indenture on how to proceed with an auction of the company.
- Representing an individual against a claim for breach of fiduciary duty related to his role as a trustee.
