Thomas focuses his practice on complex patent litigation and intellectual property (IP) counseling in a variety of technologies, including biotechnology, telecommunications and medical devices. Quick, objective and thorough, he provides his clients with accurate analyses of important and complex issues.
Thomas has represented clients before the U.S. district courts, the USPTO Patent Trial and Appeal Board (PTAB), and the Federal Circuit. He has significant experience with Alice case law, patent venue, and claim construction issues.
During law school, Thomas was a part of the Entrepreneurship and Community Development Clinic, in which he provided IP and transactional business law representation to small businesses in the Austin area. Prior to law school, he worked as an engineer in the construction industry, focusing on project management and infrastructure design for commercial buildings. From his experience managing complex construction projects, Thomas understands the importance of teamwork, prioritizing and efficient use of time for his clients. He is a regular contributor to the Federal Circuit Bar Association Monthly Case Digest.
In addition to his IP litigation experience, Thomas has represented pro bono clients in a wide range of matters, with an emphasis on assisting individuals seeking legal guardianships over incapacitated adults.
- Representing an agricultural biotechnology firm in the Western District of Wisconsin, where the client asserted claims of patent infringement and trade secret misappropriation, while simultaneously defending against breach of contract claims.
- Enforcing client’s patent portfolio in the District of Delaware against a manufacturer of cell-sorters in the biomedical field.
- Defended client’s patents involving microfluidic technology in several inter partes review proceedings before the PTAB.
- Enforced patent portfolio in the District of Colorado against a licensee who violated the terms of a license agreement with the client, while simultaneously defending against claims of anticompetitive conduct.
- Enforced equitable decree in the Eastern District of Texas against a medical device manufacturer who used the client’s trade secrets to develop products.
