Akin Gump Advises Clients in Two of Law360’s “Top International Trade Cases of 2021”

(Washington, D.C.) – Akin Gump is pleased to share that its international trade lawyers advised clients in two of the four cases that Law360 selected as its top international trade cases for 2021.
Solar Energy Industries Association et al. v. U.S. was a case before the Court of International Trade (CIT) that involves the President’s power to expand tariffs that have been imposed in response to an unforeseen import increase. The case began in the Trump administration, as it expanded duties to a type of solar panel previously exempted from tariffs. In its decision, the CIT struck down the Trump administration’s attempt to reinstate emergency tariffs on the panels. Akin Gump international trade partner Matthew Nicely and counsel Julia Eppard, Devin Sikes and Daniel Witkowski and Supreme Court and appellate partner James Tysse comprised the client team supporting the solar panel importers.
National Association of Manufacturers v. Treasury was a case before the Federal Circuit, where that court struck down U.S. Customs and Border Protection regulations prohibiting the drawback refund of alcohol excise taxes upon the export of substituted and same condition alcoholic beverages produced in the United States. In doing so, the Federal Circuit upheld a CIT decision. The decision confirms the authority of beer, wine and alcohol producers to receive these excise tax refunds via drawback when exporting substituted and same condition (as those imported) beverages produced in the United States. The case was brought by the National Association of Manufacturers and the Beer Institute.
