Akin Gump Defeats False Claims Act Charge Against Health Care Client

(Washington, D.C.) – Akin Gump Strauss Hauer & Feld LLP achieved a favorable judgment in the U.S. District Court for the Northern District of Mississippi on behalf of Golden Living, a Texas-based health care service provider. Golden Living was accused of violating the False Claims Act (FCA) and entering into a kickback scheme with drug maker McKesson.

The federal government had sued Golden Living for $895 million. After 14 days of trial, 24 witnesses, several hundred exhibits and post-trial briefing, the court ruled that Golden Living’s predecessor company, Beverly Enterprises, and McKesson did not violate the FCA or the Anti-Kickback Statute. This is the latest in a string of FCA cases that Akin Gump has successfully defended, many of them involving the health care industry.
