Privacy & Cybersecurity Law Report has published the article “Virginia Consumer Data Protection Act: What Businesses Need to Know.” Originating as an Akin Gump client alert, the article was authored by Natasha Kohne and Michelle Reed, co-heads of the firm’s cybersecurity, privacy and data protection practice; counsel Molly Whitman and Lauren York; and associates Rachel Kurzweil and Tina Jeffcoat.

The article discusses some key aspects of Virginia’s new Consumer Data Protection Act, which was signed into law earlier this year and goes into effect in 2023. The authors outline who must comply with the law, what compliance entails and which data is exempt. They also discuss the rights that consumers have under the law, which they note, incorporates aspects of the California Consumer Privacy Act, the California Privacy Rights Act and the European Union’s General Data Protection Regulation.
