Orders a hiring freeze of Federal civilian employees, to be applied throughout the executive branch.  As part of this freeze, no Federal civilian position that is vacant at noon on January 20, 2025, may be filled, and no new position may be created except as otherwise provided for in the EO or other applicable law.  The freeze does not apply to military personnel of the armed forces or to positions related to immigration enforcement, national security or public safety.  It also purports to not adversely impact the provision of Social Security, Medicare or Veterans’ benefits and allows the Director of the Office of Personnel Management to grant exemptions where necessary.

Effective February 19, 2024, no department or agency of the U.S. government shall issue documents recognizing U.S. citizenship, or accept documents issued by State, local, or other governments or authorities purporting to recognize U.S. citizenship, to persons when their mother was unlawfully present in the U.S. and their father was not a U.S. citizen or legal permanent resident at the time of their birth; or when their mother’s presence in the U.S. was temporary, including when visiting the U.S. under the Visa Waiver Program or visiting on a student, work, or tourist visa, and their father was not a U.S. citizen or legal permanent resident at the time of their birth.

This Order directs the construction of temporary and permanent physical barriers at the southern border of the United States and all appropriate action to deploy permanent sufficient personnel along the southern border to ensure operational control.  The Order also directs that action be taken to supplement available personnel to secure the southern border and enforce immigration laws.  This Order directs the Secretary of Homeland Security to issue new policy guidance on detention of undocumented immigrants and to reinstitute the Migrant Protection Protocols (“Remain in Mexico”).

The Order suspends the U.S. Refugee Admissions Program (USRAP).  Effective January 27, 2025, entry under the USRAP is suspended and decisions on applications for refugee status are suspended.  The Secretary of State and Secretary of Homeland Security may jointly determine to admit refugees on a case-by-case basis.  Within 90 days, and every 90 days thereafter, the Secretary of State will report to the President whether resumption of USRAP is in the interest of the United States.
