Biography
  • Advises on contested issues in restructuring, bankruptcy and creditors’ rights litigation in bankruptcy, district and appellate courts.
  • Represents creditors, debtors, bondholders, hedge funds, institutional investors and ad hoc and official creditors’ committees in chapter 11 and chapter 15 cases and cross-border insolvency proceedings.

Avi Luft is a committed restructuring litigator, taking the lead on all aspects of complex financial restructuring litigation matters.  Having litigated some of the most complex chapter 11 cases and cross-border insolvencies, Avi focuses on impactful and creative advocacy to facilitate the strongest outcomes for his clients within the broader bankruptcy case or restructuring process. Avi frequently serves as lead trial counsel in bankruptcy and district courts throughout the country, and commonly advises clients on the litigation implications of restructuring decisions and corporate transactions.

Avi also regularly represents major international and domestic corporations, private equity and hedge funds and financial service companies in bet-the-company complex commercial, M&A and securities litigations and international arbitrations. Avi conducts internal investigations for debtors and creditors, as well as multinational financial institutions, examining issues of fraud and regulatory compliance.

  • Enviva: Counsel to the Official Committee of Unsecured Creditors in the chapter 11 cases of Enviva, the world’s largest wood-based biomass company, involving over $2 billion in liabilities.
  • Yellow Corporation: Counsel to the Official Committee of Unsecured Creditors in the chapter 11 cases of Yellow Corporation, an American-based trucking and transportation services company that operated one of the largest less-than-truckload networks in North America, involving over $1.2 billion of liabilities.
  • Steward Health Care: Counsel to the Official Committee of Unsecured Creditors in the chapter 11 case of Steward Health Care, the largest private, physician-led health care network in the U.S.
  • Ho Wan Kwok: Counsel to the Chapter 11 Trustee in the bankruptcy cases of Ho Wan Kwok before the U.S. Bankruptcy Court for the District of Connecticut.
  • Diamond Sports Group: Counsel to ad hoc group of cross-holders in the chapter 11 cases of Diamond Sports Group before the U.S. Bankruptcy Court for the Southern District of Texas.
  • 4D Factory Inc.: Counsel to Neon Machine Shareholders, Griffin and Polychain in connection with the chapter 11 cases of 4D Factory Inc. before the U.S. Bankruptcy Court for the Southern District of New York.
  • Celsius Network: Pool counsel to executives of Celsius Network in connection with its chapter 11 case before the U.S. Bankruptcy Court for the Southern District of New York.
  • Chesapeake Energy: Counsel to the Indenture Trustee in the chapter 11 cases of Chesapeake Energy before the U.S. Bankruptcy Court for the Southern District of Texas.
  • Cred Inc.: Lead litigation counsel for Cred Inc., as debtor, in its chapter 11 cases before the U.S. Bankruptcy Court for the District of Delaware.
