Biography
  • Advises on domestic and cross-border financial restructurings and debt resolution.

Matthew is a member of the financial restructuring group. His experience focuses on cross-border financial restructurings across a number of industries.

He advises creditors, companies, directors and officeholders on restructurings, distressed acquisitions, formal insolvency proceedings, consensual re-financings and workout strategies.

Matthew also has experience in insolvency litigation and has acted for a wide range of insolvency litigation funders in their assessment, acquisition and pursuit of claims in a distressed context, including claims relating to wrongful and fraudulent trading, directors' duties, contractual disputes and asset recovery.

Representative Work
  • Cineworld: Counsel to an ad hoc group of secured lenders in the chapter 11 cases of Cineworld and its affiliates, the world’s second-largest movie chain, involving $4 billion in liabilities.
  • VEON: Counsel to the VEON group, a multinational telecommunication services business, in relation to a scheme of arrangement to extend the maturity of certain USD bonds and other related matters.
  • Noble: Counselt to an ad hoc group of creditors on the financial and corporate restructuring of the Noble group, a worldwide commodities supply chain and trading business.
  • Folli Follie: Counsel to the ad hoc committee of creditors on the c. €500 million debt-for-equity restructuring of the Greek-listed company Folli Follie, involving advising on the implementation of a first-of-its-kind Greek Bankruptcy Code rehabilitation agreement requiring delivery of the opco and assetco structure to the creditors via a new corporate group.
  • Teneo: Acted for Deloitte (now Teneo) as administrators on the bringing of c. £36 million of fraudulent and wrongful trading claims arising out of the insolvency of a large UK haulage supply company.
  • Lender: Advised a secured lender of a UK-listed African natural gas company on maintaining and improving its security package in the face of ongoing defaults and difficult market conditions for the borrower, including advice on shadow directorship, debt-for-equity restructuring options and facilitating a negotiated solution across multiple stakeholders.
  • Lender: Advised the mezzanine lender on a commercial offices building in central London on recourse options in response to anticipated enforcement by the senior lender, including security review and report on a mezzanine vs. senior lending and security packages and advising on the available strategies for the mezzanine lender vis-à-vis the sponsor and the senior lender.
  • Bank: Acted for a UK clearing bank on the COVID-19 required amendment and restatement of facilities provided to the Cardiff chain of a large UK hotel brand, including the injection of further junior lending from stakeholders to allow the borrower to demonstrate a viable COVID recovery plan.
