Each member of Akin’s government contracts team is a market-leading litigator. Our lawyers advise on all types of government contract claims, disputes and litigation. We are experienced in federal, state and local procurement processes, laws and regulations, federal contract formation and administration issues, and government contract-related dispute resolution practices.
From assisting technology companies threatened with default terminations to securing litigation wins on behalf of construction companies involving millions of dollars in claims, our government contracts team assists clients on the full array of government contract-related disputes. Our services include handling civil, criminal and congressional investigations, as well as prime-subcontractor disputes.
We have conducted numerous internal investigations regarding mischarging, cost allowability, the Anti-Kickback Act, violations of laws governing bribery and gratuities, and conflict of interest issues and have advised clients on mandatory and voluntary disclosures to multiple civilian and defense agencies.
Our government contracts lawyers routinely handle bid protests before the Government Accountability Office (GAO) and U.S. Court of Federal Claims, suspension and debarment proceedings before multiple U.S. government agencies, and contract claims and disputes before civilian and defense Boards of Contract Appeals. We have worked with government contractors on complex cost accounting matters, including Cost Accounting Standards (CAS) audits, disputes and claims.
We also have substantial experience in arbitrations, mediations, mini-trials and other forms of alternate dispute resolution, including international arbitrations and mediations. If a dispute occurs during the performance of a government contract or subcontract, we assist the client in claims preparation and settlement negotiations.
If the matter cannot be settled, we represent our clients in subsequent appeals to a Board of Contract Appeals or to the Court of Federal Claims when the claim is against the government. When the dispute involves a subcontractor, we litigate in state and federal courts or represent the client in arbitration proceedings.
