- Advised Vista Credit Partners, a subsidiary of Vista Equity Partners and a strategic credit and financing partner focused on the enterprise software, data and technology markets in its $300 million financing for Zinnia, a leading life and annuity insurance technology company. The funding will accelerate Zinnia’s mission to power industry growth by modernizing the life and annuity experience.
- Represented a global private markets investment firm on a term loan and delayed draw term loan NAV facility financing for a private equity investment firm that focuses on control investments in the lower middle market.
- Advised General Atlantic Credit as the lead investor in a $425 million preferred equity investment in Buyers Edge Platform, a leader in digital procurement solutions for the food service industry.
- Advised Bain Capital Credit LP, a leading global credit specialist, in connection with the acquisition of a portfolio of 17 aircraft engines from Rolls-Royce PLC valued at more than $450 million by its aviation platform Griffin Global Asset Management. Certain funds managed or advised by Bain Capital Credit LP provided substantially all of the equity capital required to fund the transaction. The engines are owned by a newly formed standalone entity and will be enrolled in Rolls-Royce’s TotalCare program and leased to various operators that utilize Rolls-Royce engines in their active fleet of aircraft.
- Advised Intrum AB, one of Europe’s largest nonperforming loan servicers, in its agreement to sell a material portion of its investment portfolio to affiliates of Cerberus Capital Management LP for more than €1 billion. This transaction involved over 10,000 portfolios in 13 jurisdictions across Europe with a nominal value of €33 billion, as of September 30, 2023. As part of the transaction, Intrum retains a 35% ownership stake in the purchasing entity owning these assets and has entered into a minimum of five-year exclusive agreement to retain the servicing of the full portfolio. Akin assisted Intrum on all aspects of this transaction, including the asset sales, pre-sale reorganization, pan-European servicing arrangements, financing, joint venture matters, tax structuring, regulatory advice and overall transaction management.
